This Seminar will cover the points that you need to be aware of and will provide the practical steps that organisations need to take to meet the introduction of the proactive duty on employers to take reasonable steps to prevent sexual harassment in the workplace. The duty comes into force from 26 October 2024 with employers no longer able to hide behind having a policy in their employee handbook as a defence. The EHRC has also updated technical guidance which now includes a duty to take reasonable steps to prevent sexual harassment not only in respect of employee vs employee but also in respect of third parties sexual harassment too.
We will cover:
- What constitutes workplace sexual harassment.
- The special status of sexual harassment, covering the existing employers “all reasonable steps” defence.
- The new duty on employers to prevent sexual harassment.
- Steps that organisations should take to demonstrate compliance with the new duty.
- Related grievance/ disciplinary process.
- Potential damages.

About the speaker
Shiva Shadi is a Partner and Head of Employment Law at Davis Blank Furniss Solicitors. Shiva has 27 years’ experience in advising employers in all aspects of employment law and HR related matters for SMEs. She also represents employers in the Employment Tribunals, delivers seminars and provides internal training courses.
